6520. (F.D.C. No. 43688. S. Nos. 44-522 P, 44-540 P, 44-546 P, 44-661 P, 44- 665 P, 56-385 P.) INFORMATION FILED: 1-26-60, W. Dist. N.C, against Charlotte Drug Co. (a partnership), Charlotte, N.C, Sidney Schenck (a partner in the partnership), and Robert Frank Holland (an employee of the partnership). CHARGE: Between 12-9-58 and 1-30-59, Dexedrine Sulfate tablets (counts 1, 2, 3, and 5) were dispensed 4 times, Dexamyl tablets (count 4) and secobarbital sodium capsules (count 6) were each dispensed once upon requests for pre- scription refills without authorization from the prescriber. PLEA : Not guilty by Charlotte Drug Co. to all counts of the information; by Sidney Schenck to count 1; and by Robert Frank Holland to counts 2 to 6 inclusive. DISPOSITION : The case came on for trial before the court without a jury on 10-25-60, and at its conclusion, Charlotte Drug Co. and Robert Frank Holland were found guilty, and Sidney Schenck was found not guilty. On 4-5-61, the court fined the company $750 and Holland $350 on counts 1, 2, and 3, and continued the prayer for judgment against such defendants on counts 4, 5, and 6 for 3 years on condition that-Holland should not be employed by the company. .
