INFORMATION FILED: 10-15-59, W. Dist. N.C., against Elbert P. Phillips, t/a 
Queen City Pharmacy, Charlotte, N.C, and Lemuel A. Yancey (pharmacist).
CHARGE: Between 6-30-58 and 9-18-58, Dexedrine Sulfate tablets were dis- 
pensed 4 times (counts 2, 5, 7, and 8), Nembutal Sodium capsules were dis- 
pensed 4 times (counts 3, 4, 6, and 9), and Seconal Sodium capsules were 
dispensed twice (counts 1 and 10) upon requests for prescription refills with- 
out authorization from a prescrlber.
PLEA:   Not guilty to all counts by Phillips; nolo contendere to counts 1 to 5
inclusive by Yancey. 
DISPOSITION :   The case against Phillips came on for trial before the court and
jury and, on 10-6-60, the jury returned a verdict of guilty.   On 4-7-61, Phillips
was fined $750 and Yancey $350.
