CHARGE: 502(a)-when shipped, the labeling of the article contained false and misleading representations that the article was an adequate and effective treatment for obesity and controlling the appetite, and that the article would give the feeling of a full, contented stomach when reducing, and would keep its consumer feeling fine while losing weight. The libel alleged also that the article was misbranded under the provisions of the law applicable to foods, as reported in notices of judgment on foods. DISPOSITION : On 6-3-60, John H. Mathis, Inc., filed a claim and answer. On 5-23-61, the action came on for hearing before the court, and there was no appearance on behalf of any claimant. On 1-15-62, the article was ordered condemned and destroyed.
