On or about January 19, 1910, the New Blue Grass Canning Com?? pany, Owensboro, Ky., shipped from the State of Kentucky to the? State of Georgia 44 barrels, 15 half barrels, and 22 kegs containing? 15 gallons each of alleged tomato catsup, twelve of which barrels? were labeled "Jumbo Tomato Catsup," the remainder bearing no? label. Examination of samples of this product made by the Bureau? of Chemistry, United States Department of Agriculture, showed? it to be adulterated within the meaning of the Food and Drugs Act? of June 30, 1906. As it appeared from the findings of the analyst? and report made that the said shipment was liable to seizure under? section 10 of the act, the Secretary of Agriculture reported the facts? to the United States attorney for the Northern District of Georgia. In due course a libel was filed in the District Court of the United? States for said district against the said barrels, half barrels, and? kegs of tomato catsup, charging the above shipment and alleging? that the product so shipped was adulterated, in that it consisted? in part of a filthy and decomposed vegetable substance. The case coming on for hearing and there being no appearance by? any claimant to the product, the court being fully informed in the? premises, issued its decree finding the above-mentioned product? to be adulterated as alleged in the above libel, condemning and for?? feiting the same to the United States and ordering its destruction? by the marshal of said district, which order was forthwith executed. This notice is given pursuant to section 4 of the Food and Drugs? Act of June 30, 1906. W. M. HAYS,? Acting Secretary of Agriculture. WASHINGTON, D. C, September 26, 1910. 61424??No. 622?10
