(Glren pursuant to section 4 of the Food and Drugs Act.) ADULTEKATION OF CLAMS. On October 10, 1910, the United States Attorney for the District? of Massachusetts, acting upon a report by the Secretary of Agri?? culture, filed information in the District Court of the United States? for said district against D. Aubin, alleging shipment by him, in vio?? lation of the Food and Drugs Act, on or about December 9, 1909;,? from the State of Massachusetts into the State of New Hampshire? of a quantity of clams which were adulterated. The tub containing? the product was labeled: "Hodgdon & Kershaw, 2 Congress St.,? Portsmouth, N. H." Examination of a sample of said product made by the Bureau of? Chemistry of the United States Department of Agriculture showed? the presence of an excessive number of organisms, including mem?? bers of the B. coli group and streptococci, in sufficient numbers to? render the product unfit for human consumption. Adulteration was? alleged for the reason that the product consisted in part of a filthy,? decomposed, or putrid animal substance.
