In Notice of Judgment No. 1153 report was made of the judgment? of the District Court of the United States for the District of Mary?? land , entered in the case of the United States v. McCormick & Co.? The information filed against the defendant corporation alleged the? shipment, on or about March 11, 1910, from the State of Maryland? into the State of Pennsylvania, in violation of the Food and Drugs? Act, of a quantity of so-called pure paprika, which was misbranded.? This Department had not been informed, when Notice of Judgment? No. 1153 was issued, that the court accompanied the judgment by a? statement setting forth its reasons for imposing a fine of 50 cents.? The statement of the court, communicated by the United States attor?? ney, under date of November 20, 1911, which is self-explanatory, was? as follows: The Court, being satisfied in this caae that the failure to designate on the label the? fact that the paprika was ground in oil was a mere omission of a subordinate employee,? contrary to the instructions of the defendant, imposes a fine of fifty cents and re?? quests that this statement be embodied in any publication of the sentence which may? be made by the Department of Agriculture.
