NOTICE OF JUDGMENT NO. 2196. (Given pursuant to section 4 of the Food and Drugs Act.) ADULTERATION OF CATSUP. On November 4, 1912, the United States Attorney for the District of Maryland, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district an information against the Atlas Preserving Co. (Inc.), Baltimore, Md., alleging shipment by said company, in violation of the Food and Drugs Act, on November 9, 1910, from the State of Maryland into the District of Columbia of a quantity of catsup which was adul- terated. The product was labeled: "Atlas Brand Catsup. 1-10 of 1% Benzoate of Soda. Atlas Preserving Co., Baltimore, Md." Analysis of a sample of the product by the Bureau of Chemistry of this Department showed the following results: Yeasts and spores, 101 per one-sixtieth cubic millimeter; bacteria, 192,000,000 per cubic centimeter; mold filaments in 56 per cent of the fields examined. Adulteration of the product was alleged in the information for the reason that it consisted in part of a filthy and decomposed vegetable substance, to wit, tomatoes.
