NOTICE OF JUDGMENT NO. 2539. (Glen pursuant to section 4 of the Food and Drugs Act.) 17. S. v. Ungerer & Co. (Inc.). Plea of guilty. Fine, $10. ADULTERATION OF OIL OF ANISE. On March 5, 1913, the United States Attorney for the Southern District of New York, acting upon a report by the Secretary of Agri- culture, filed in the District Court of the United States for said dis- trict an information against Ungerer & Co. (Inc.), a corporation, New York, N. Y., alleging shipment by said company, in violation of the Food and Drugs Act, on June 3, 1909, from the State of New York into the State of Missouri of a quantity of oil of anise which was adulterated. The product was labeled: "Oil of Star Anise (Oleum Anisi Stellati). S. C. 0.975-0.985 at 25° C. (77° F) C. P.+15°-f 16° C Guaranteed under the Food and Drugs Act June 30, 1906, Serial Number 521. Ungerer & Co., New York Chi- cago Philadelphia." An analysis of the sample of the product by the Bureau of Chem- istry of this Department showed the following results: Specific gravity at 25° C, 0.9848; refruitive index at 20° C, 1.5480; optical rotation 100 mm 20° C, —0.90°; soluble in 1 volume of 95 per cent alcohol; soluble in 5 volumes of 90 per cent alcohol; phenols absent; lead absent; congealing point, +11.0° C. Oil is not U. S. P. Con- gealing point is too low. Adulteration of the product was alleged in the information for the reason that it was sold under and by a name recognized in the United States Pharmacopoeia, to wit, oil of anise, and it differed from the standard of strength, quality, and purity as determined by the test laid down in said Pharmacopoeia official at the time of said shipment and investigation, in that the congealing point of said drug was below 15° C., and was, in fact, 11° C, whereas 10453°—No. 2539—13 said Pharmacopceia provides as a test for oil of anise that its con- gealing point should not be below 15° C.
