On March 15, 1915, the United States attorney for the Northern District of Iowa,? acting upon a report by the Secretary of Agriculture, filed in the District Court of the? "United States for said district an information against George H. Gurier and Charles? H. Gurier, copartners, trading under the firm name of Gurier & Co., Cedar Rapids,? Iowa, alleging shipment by said defendants, in violation of the Food and Drugs Act,? en or about April 1, 1913, from the State of Iowa into the District of Columbia, of a? quantity of butter which was misbranded. The product was labeled: "16 oz. net? weight Brookfield Extra Creamery Butter." Examinations of samples of the product by the Bureau of Chemistry of this depart?? ment showed the following results: WEIGHTS 10 PRINTS. Misbranding of the article was alleged in the information for the reason that the? statement, to wit, "16 oz.," borne on the label attached to the package containing? the article, was false and misleading in that it purported and represented that the? ?contents of each of the packages weighed 16 ounces, whereas, in truth and in fact, the? contents of each of said packages did not weigh 16 ounces, but did weigh a less amount;? misbranding was alleged for the further reason that each package of the article was? labeled "16 oz." so as to deceive and mislead the purchaser into the belief that the? contents of each of the packages weighed 16 ounces, whereas, in truth and in fact, the? contents of each of said packages did not weigh 16 ounces, but did weigh a less amount.
