4245. Adulteration of pepper. U. S. ? * * * v. 200 Boxes * * * of an? Article Purporting; to be Pepper. Consent decree of condemnation? and forfeiture. Product ordered released on bond. (F. & D. No. 6551. I. S. No. 359-k. S. No. E-274.) On May 19, 1915, the United States attorney for the District of Columbia,? acting upon a report by the Secretary of Agriculture, ' filed in the Supreme? Court of the District aforesaid, holding a district court, a libel for the seizure? and condemnation of 200 boxes, more or less, of an article purporting to be? pepper, remaining unsold in the original unbroken packages at Washington,? D.'C, alleging that the same were being held and offered for sale in the District? aforesaid, in violation of the Food and Drugs Act. The boxes were labeled, in? part: " No. 377 * * * American Brand Purity Strength Pepper 5 lbs. net." Adulteration was alleged in the libel for the reason that the said article of? food had been mixed and packed with a substance, to wit, pepper shells, which? reduced and lowered and injuriously affected its quality and strength, and,? further, for the reason that another substance had been substituted, in whole? and [or] in part, for the genuine article of food. On July 21, 1915, Parrish Bros., a corporation, Baltimore, Md., claimant,? having consented thereto, judgment of condemnation and forfeiture was- entered? as and for June 28, 1915, and it was ordered by the court that the product? should be delivered to said claimant, upon payment of the costs of the pro?? ceedings and the execution of bond in the sum of $1,000, in conformity with? section 10 of the act.
