George Roncoroni, New York, N. Y., alleging shipment by said defendant, in? violation of the Food and Drugs Act, on August 25, 1914, from the State of? New York into the State of Pennsylvania, of a quantity of tomato paste, which? was adulterated. The product was labeled: (On can) "Tomato Paste Red? Alloway Pkg. Co. Alloway, N. J. Net Weight 14 Oz. Serial No. 10788." (On? shipping package) "Tomato Paste G. Roncoroni, 148 Spring St., N. Y." Examination of samples of the product by the Bureau of Chemistry of this? department showed the following results: A partially decomposed vegetable product. Adulteration of the article was alleged in the information for the reason that? it consisted in whole or in part of a filthy and decomposed vegetable matter.
