On July 21, 191q, the United States attorney for the Southern District of? New York, acting upon a report by the Secretary of Agriculture, filed, in the? District Court of the United States for said district a libel for the seizure and? condemnation of 3 kegs, each containing about 125 pounds of butter, remain?? ing unsold in the original unbroken packages at New York, N. Y., alleging that? the product had been shipped on or about July 1, 1915, and transported from? the State of Tennessee into the State of New York, and charging adulteration? in violation of the Food and Drugs Act. Adulteration was alleged in the libel for the reason that said article of food? consisted in part of a moldy animal product, to wit, butter, and contained mag?? gots, contrary to the provisions of section 7, subdivision 6, under " Food,", of? the Food and Drugs Act.?
