On November 5, 1910, the United States attorney for the Northern District? of Illinois, acting upon a report by the .Secretary of Agriculture, filed in the? District Court of the United States for said district an information, and on? March 28, 1913, and July 27, 1915, amended informations, against Robert? Smithson, Chicago, 111., alleging shipment by said defendant, in violation of the? Food and Drugs Act, on May 7, 1910, from the State of Illinois into the State? of New York, of a quantity of frozen egg product which was adulterated. Bacteriological examination of samples of the article by the Bureau of? Chemistry of this department showed the presence of an excessive number of? organisms, including members of the B. coli group and streptococci. Adulteration of the article was alleged in the information for the reason? that when it was so shipped and delivered for shipment, as aforesaid, it con?? sisted in part of a filthy animal substance which rendered it unfit for food;? for the further reason that it consisted wholly of a decomposed animal sub?? stance which rendered it unfit for food; for the further reason that it con?? sisted in part of a decomposed animal substance which rendered it unfit for? food; and for the further reason that it consisted in part of a putrid animal? substance which rendered it unfit for food.
