No. C-389.; On November 17, 1915. the United States attorney for the Eastern District? of Louisiana, acting upon a report by the Secretary of Agriculture, filed in the? District Court of the United States for said district a libel for the seizure? and condemnation of 418 sacks of rice, remaining unsold in the original un?? broken packages at New Orleans, La., alleging that the article had been shipped? by Goble Jinainez, San Juan, P. R?, on November 7, 1915, and transported from? the island of Porto Rico into the State of Louisiana, and charging adultera?? tion, in violation of the Food and Drugs Act. The article was labeled: '? Con?? taminated rice N. O. Held N. Y. San Juan." Adulteration of the article was alleged in the libel for the reason that it? consisted of a filthy, decomposed, and putrid vegetable substance, and that the? same was unfit for food. On February 23, 1916, A. Held, New York, N. Y., claimant, having filed its? [his] answer, admitting the allegations in the libel snd consenting to a deeree,? judgment of condemnation and forfeiture was entered, and it was ordered by? the court that the product should be delivered to the said claimant upon the? payment of all costs of the proceedings and the execution of bond in the sum? of $1,000, in conformity with section 10 of the act. The decree recited that the? product should be delivered to the said claimant for the sole purpose of putting? the rice through a process of cleaning in the presence of the food inspector? of the Department of Agriculture, and that representative samples of the re?? processed rice should be furnished to said inspector to be passed upon by the? Department of Agriculture to ascertain and determine whether or not the? article, or any part thereof, would then be suitable for human food, and with? the further condition that if upon the cleaning of the rice the same be found? by the department to be unfit for human or animal food, that the same should? be delivered to the marshal of the Eastern District of Louisiana to be destroyed? by him.
