Jacob Shucart, doing business? under the name of the National Bottling Co., St. Louis, Mo., involving the ship?? ment of a quantity of cider, which was alleged to be adulterated and mis-? branded, having come on for retrial by the court and jury, after the submission? of evidence and arguments by counsel, the court delivered its charge to the? jury and a verdict of guilty was returned, whereupon the court imposed a fine? of $200 on eaoh of two counts of the information, making an aggregate fine? of $400 with the costs, of the proceedings. On May 9, 1916, defendant by his counsel filed his motion for a new trial? and in arrest of judgment, which was overruled by the court, whereupon the? defendant filed his petition for a writ of error and assignment of errors, which? writ was allowed, and the case was carried on said writ of error in the United? States Circuit Court of Appeals for the Eighth Circuit, On May 10, 1917, the? writ of error was dismissed by stipulation of the parties, and thus the judg?? ment of the lower court stands confirmed.
