On April 29, 1916, the United States attorney for the Southern District of Illinois, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel for the seizure and condemnation of 475 cases, each containing- 2 dozen cans of pork and beans, remaining unsold in the original unbroken packages at Peoria, 111., alleging that the article had been shipped on February 16, 1916, by the Wisconsin Pea Can- ners Co., Manitowoc, Wis., and transported from the State of Wisconsin into the State of Illinois, and charging adulteration in violation of the Food and Drugs Act The article was labeled in part: " Eureka Brand High Grade Pure Food Products Pork and Beans with tomato sauce Quality guaranteed? * $ $ >? It was charged in substance in the libel that the article was adulterated for? the reason that it consisted in part of a decomposed vegetable substance. On October 26, 1916, the saicl Wisconsin Pea Canners Co., claimant, having? appeared and consented to a decree, judgment of condemnation and forfeiture? was entered, and it was ordered by the court that the product should be re?? delivered to said claimant upon payment of the costs of the proceedings and? the execution of a bond in the sum of $1,000, in conformity with section 10 of? the act.
