5441. Adulteration, and alleged Misbranding of bKans. IT. S. * * * v. 80 Cases, of Beams. Default decree of cosidesnixation, foi-feitrare, and destruction. (F. & D. No. 8044. I. S. No. 10752-m. S. On January 30, 1917, the United States attorney for the District of Colorado, acting upon a report by the Secretary of Agriculture, filed in the District Cotirfc of the United States-for said district a libel for the seizure and condemnation of 80 cases of beans, consigned on December 29, 1916, by the Ridenour Baker Grocer Co., Kansas City, Mo., remaining unsold in the original unbroken pack- ages at Sterling, Colo., alleging that the article had been shipped and trans- ported from the State of Missouri into the State of Colorado, and charging adulteration and misbranding in violation of the Food and Drugs Act. The article was labeled: " Gilt Edge Brand Baked Beans Packed by Union Pack- ing Co. Omaha, Neb." Adulteration of the article was alleged in the libel for the reason that it con- sisted in part of partly decomposed bKans. Misbranding was alleged for the reason that the statement a the label indi- cated and was calculated, to make the purchasers thereof believe that said article was baked beans, whereas it was not, but had been cooked by another process. On March 7, 1917, no claimant having appeared for the property, judgment of condemnation and forfeiture was entered, the court finding the product adul- terated, and it was ordered that said product should be destroyed by the United States marshal.
