5728. Adulteration of porlc and bKans. U. S. * * * v. 650 Cases * * * Porlc and BKans. Default decree of condemnation, forfeiture, and sale. (F. & D. No. 7985. I. S. No. 11531-m. S. No. C-631.) On January 16, 1917, the United States attorney for the District of Kansas, acting upon a report by the Secretary of Agriculture, filed in the Dis- trict Court of the United States for said district a libel for the seizure and condemnation of 650 cases of pork and beans, remaining unsold in the original unbroken packages at Dodge City, Kans., alleging that the article had been shipped on or about November 4, 1916, by the Union Packing Co., Omaha, Nebr., and transported from the State of Nebraska into the State of Kansas, and charging adulteration in violation of the Food and Drugs Act. The article was labeled in part, " Front Rank Brand Pork and BKans. Packed by Union Packing Co. Omaha Neb." Adulteration of the article was alleged in the libel for the reason that it consisted in part of a filthy and decomposed vegetable substance. On April 3, 1917, no claimant having appeared for the property, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product should be sold by the United States marshal and that the purchaser should execute a bond in the sum of $500, conditioned that the prod- uct would not be sold or transported in interstate commerce or sold for human food in violation of the laws of the United States or of the State of Kansas. C. F. MAEVIN, Acting Secretary of Agriculture.
