5744. Adulteration of bKans. V. S. * * * v. W. F. Assan Canning Co., a corporation, Plea of snii y- Fine, $15 and costs. (F. & D. No. 8039. I. S. No. 4335-1.) On June 27, 1917, the United States attorney for the District of Maryland., acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district an information against the W. F. Assau Canning Co., a corporation, Baltimore, Md., alleging shipment by said company, in violation of the Food and Drugs Act, on or about April 12, 1916, from the State of Maryland into the State of Massachusetts, of a quantity of an article labeled in part, " Bunker Hill Brand Beans * * * Packed by W. F. Assau Canning Co. * * * at Baltimore, Md.," which was adulterated. Analysis of a sample of the article by the Bureau of Chemistry of this department showed that the beans were partly decomposed. Adulteration of the article was alleged in the information for the reason that it consisted in part of a filthy, decomposed, and putrid vegetable substance. On June 27, 1917, the defendant company entered a plea of guilty to the information, and the court imposed a fine of $15 and costs. C. F. MARVIN, Acting Secretary oj AyvicuUure.
