On August 16, 1917, the United States attorney for the District of Colorado,? acting upon a report by the Secretary of Agriculture, filed in the District Court? of the United States for said district a libel for the seizure arid condemna?? tion of 27 cases of shell eggs, consigned by the Farmer's Mercantile Co., Long? Island, Kans., remaining unsold in the original unbroken packages at Denver,? Colo., alleging that the article had been shipped on or about July 31, 1917,? and transported from the State of Kansas into the State of Colorado, and? charging adulteration in violation of the Food and Drugs Act. Adulteration of the article was alleged in the libel for the reason that it? consisted in part of filthy, putrid, and decomposed matter. On October 26, 1917, the Farmer's Cooperative Mercantile Association,? claimant, having admitted the allegations of the libel, the court found that? the product was adulterated and that libellant was entitled to a judgment? condemning and forfeiting the eggs, and the eggs having been candled, It was? ordered that the good portion should be released to said claimant and the? unfit portion should be destroyed by the United States marshal, and that the? costs of the proceedings be taxed against the said claimant.
