On August 16, 1917, the United States attorney for the District of Colorado,? acting upon a report by the Secretary of Agriculture, filed in the District Court? of the United States for said district a libel for the seizure and condemnation? of 12 cases of shell eggs, consigned by B. E. Stires Co., Ludell, Kans., remain?? ing unsold in the original unbroken packages at Denver, Colo., alleging that? the article had been shipped on or about-July 31, 1917, and transported from? the State of Kansas into the State of Colorado, and charging adulteration in? violation of the Food and Drugs Act. Adulteration of the article was alleged in the libel for the reason that it con?? sisted in part of filthy, putrid, and decomposed matter. On October 26, 1917, B. E. Stires, Ludell, Kans., claimant, having admitted? the allegations of the libel, the court found that the product was adulterated? and that libellant was entitled to a judgment condemning and forfeiting the? eggs, and, the eggs having been candled, it was ordered that the good portion? should be released to said claimant, that the unfit portion should be destroyed? by the United States marshal, and that the costs of the proceedings should be? taxed against the said claimant.
