On April 12, 1917, the United States attorney for the District of New Jersey, acting? upon a report by the Secretary of Agriculture, filed in the District Court of the United? States for said district an information against Luigi G. Balbi and John Gagliardi,? trading as Luigi G. Balbi & Co., Matawan, N. J., alleging shipment by said defendants,? in violation of the Food and Drugs Act, on or about November 1, 1916, from the State? of New Jersey into the State of New York, of a quantity of tomato paste which waa? adulterated. Examination of samples of the article by the Bureau of Chemistry of this department? showed that the product was made from decomposed tomatoes. Adulteration of the article was alleged in the information for the reason that it? consisted in part of a filthy, decomposed, and putrid vegetable substance.
