On July 28, 1917, the United States attorney for the Western District of? Missouri, acting upon a report by the Secretary of Agriculture, filed in the? District Court of the United States for said district a libel for the seizure and? condemnation of 29 cases, each containing 30 dozen eggs, remaining unsold in? the original unbroken packages, at Aurora, Mo., alleging that the article had? been shipped on or about July 19, 1917, by the Batesville Produce Co., Bates-? ville, Ark., and transported from the State of Arkansas into the State of? Missouri, and charging adulteration in violation of the Food and Drugs Act. Adulteration of the article was alleged in the libel for the reason that it? consisted in whole or in part of a filthy, putrid, and decomposed animal? substance. On October 5, 1917, the Bergman Produce Co., claimant, having admitted the? allegations of the libel and expressed willingness to pay the costs of the pro?? ceedings, .it was ordered by the court that the product should be delivered to? naid claimant upon the execution of a bond in the sum of $200, in conformity? with seetion 10 of the act.
