On October 12, 1917, the United States 'attorney for the Southern District? of West Virginia, acting upon a report by the Secretary of Agriculture, filed? in the District Court of the United States for said district a libel for the seizure? and condemnation of 2 barrels of gelatin at Huntington, W. Va., alleging that? the article had been shipped on or about July 16, 1917, by the Kingery Manu?? facturing Co., Cincinnati, Ohio, and transported from the State of Ohio into? the State of West Virginia, and charging adulteration in violation of the Food? and Drugs Act. Adulteration of the article was alleged in substance in the libel for the reason? that it contained added deleterious ingredients, to wit, zinc, copper and arsenic,? which might render the article injurious to health. On April 16, 1918, no claimant having appeared for the property, judgment of? 'condemnation and forfeiture was entered, and it was ordered by the court that? the product should be sold by the United States marshal. C. F.
