On May 10, 1918, the United States attorney for the Southern District of? Mississippi, acting upon a report by the Secretary of Agriculture, filed in the? District Court of the United States for said district an information against? the Producers Cotton Oil Co., a corporation, doing business at Yazoo City, Miss.,? alleging shipment by said company, in violation of the Food and Drugs Act,? as amended, on or about December 4, 1916, from the State of Mississippi into? the State of Indiana, of a quantity of cottonseed meal sold under contract as? 7 per cent ammonia cottonseed meal, which was adulterated and misbranded. Analysis of a sample of the article by the Bureau of Chemistry of this de?? partment showed the following results: Ammonia (per cent)? ?6.36 Cottonseed hulls (per cent)? At least 25 Adulteration of the article was alleged in the information for the reason? that a substance, to wit, cottonseed hulls, had been mixed and packed therewith,? so as to reduce, lower, and injuriously affect its quality and strength, and? had been substituted in part for cottonseed meal containing 7 per cent? ammonia, which the article purported to be; and for the further reason that a? product containing less than 7 per cent of ammonia, to wit, approximately? 6.36 per cent of ammonia, had been substituted in part for cottonseed meal? containing 7 per cent of ammonia, which the article purported to be. Misbranding of the article was alleged for the reason that it was food in? package form, and the quantity of the contents was not plainly and conspicu?? ously marked on the outside of the packages in terms of weight, measure, or? numerical count. On November 14, 1918, the defendant company entered a plea of nolo con?? tendere to the information, and the court imposed a fine or $25 and costs. C. F.
