On April 8, 1918, the United States attorney for the District of Maine, acting? uj)on a report by the Secretary of Agriculture, filed in the District Court of? the United States for said district a libel for the seizure and condemnation of? 200 cans of olive oil, consigned by A. L. Mihaloplos & Co., Boston, Mass., re?? maining unsold in the original unbroken packages at Lewiston, Me., alleging? that the article had been shipped on December 5, 1917, and transported from? the State of Massachusetts into the State of Maine, and charging adulteration? and misbranding in violation of the Food and Drugs Act. The article was? labeled in part, " Kilkis Brand * * * Pure Olive Oil." Adulteration of the article was alleged in the libel for the reason that cotton?? seed oil had been mixed and packed therewith so as to reduce and lower and? injuriously affect its quality and strength, and had been substituted in part for? the article labeled olive oil. Misbranding of the article was alleged in substance for the reason that the? statement borne on the cans?to wit, " Kilkis Brand * * * Pure Olive? OJJ * * * ?>?was faise anc] misleading in that each of the cans did not con?? tain pure olive oil, but the contents consisted largely of cottonseed oil. On May 10, 1918, James Kesaris, Lewiston, Me., claimant, having filed a? bond in the sum of $750, in conformity with section 10 of the act, it was? ordered by the court that the product should be released to said claimant upon? the payment of the cost of proceedings.
