On May 13, 1918, the United States attorney for the Eastern District of? Missouri, acting upon a report by the Secretary of Agriculture, filed in the? District Court of the United States for said district a libel for the seizure and? condemnation of 1 barrel containing 348 pounds of alleged gelatin, remaining? unsold in the original unbroken package at St. Louis, Mo., alleging that the? article had been shipped on or about April 3, 1918, by the Creamery Dairy Co.,? San Antonio, Tex., and transported from the State of Texas into the State of? Missouri, and charging adulteration in violation of the Food and Drugs Act. Adulteration of the article was alleged in the libel for the reason that a sub?? stance?to wit, glue, containing excessive amounts of copper and zinc?had been? mixed and packed therewith so as to reduce and lower and injuriously affect its? quality and strength, and had been substituted in part for gelatin; and that it? contained added poisonous and deleterious ingredients?to wit, copper and? zinc?which might render the article injurious to health. On October 1, 1918, the Consumers Glue Co., a corporation, St. Louis, Mo.,? having consented to a decree, judgment of condemnation and forfeiture was? entered, and it was ordered by the court that the product should be delivered? to said claimant upon the execution of a bond in the sum of $500, in conformity? with section 10 of the act.
