On November 15, 1918, the United States attorney for the District of Massa?? chusetts, acting upon a report by the Secretary of Agriculture, filed in the Dis?? trict Court of the United States for said district an information against George? A. Greene and Josie S. L. Greene, trading as Greene Chicken Feed Co., Marble-? head, Mass., alleging shipment by said defendants, in violation of the Food and? Drugs Act, on or about December 7, 1917, from the State of Massachusetts into? the State of New Hampshire, of a quantity of an article labeled in part,? " Greene's Old Fashioned Meat Scraps for Poultry, manufactured by the? Greene Chicken Feed Co., Marblehead, Mass. Protein 35-55 Per Ct," which? was adulterated and misbranded. Analysis of a sample of the article by the Bureau of Chemistry of this depart?? ment showed the following result: Protein (Nx6.25) (percent)? 24.13 Adulteration of the article was alleged in the information for the reason that? a. substance low in protein had been mixed and packed therewith so as to lower? and reduce and injuriously affect its quality, and had been substituted in part? for a product containing at least 35 per cent protein, which the article pur?? ported to be. Misbranding of the article was alleged for the reason that the statement, to? wit, " Protein 35-55?," borne on the sacks containing the article, regarding it? and the ingredients and substances contained therein, was false and misleading? in that it represented that the article contained not less than 35 per cent of? protein, and for the further reason that it was labeled as aforesaid so as to? deceive and mislead the purchaser into the belief that it contained not less than? 35 per cent of protein, whereas, in truth and in fact, it did not, but contained? a less amount, to wit, 24.33 per cent of protein. , On, December 10, 3918, the defendant, Josie S. L. Greene, entered a plea of? nolo contendere to the information, and the court imposed a fine of $25. The? information as to George A. Greene was nolle prossed. J. R.
