On May 20, 1919, the United States attorney for the Western District of Wash- ington, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel for the seizure and con- demnation of 10 barrels of walnut meats, consigned by the American Fruit Dis- tributors, Wilmington, Calif., remaining unsold in the original unbroken pack- ages at Seattle, Wash., alleging that the article had been shipped and trans- ported from the State of California into the State of Washington, arriving at Seattle on or about May 5, 1919, and charging adulteration in violation of the Food and Drugs Act. 2737?-20 2 Adulteration of the article was alleged in the libel for the reason that it con- sisted in whole or in part ot a filthy, decomposed, and putrid vegetable sub- stance. On June 10, 1919, Richardson & Holland, Inc., Seattle, Wash., claimant, hav- ing admitted the allegations of the libel, judgment of condemnation and for- feiture was entered, and it was ordered by the court that the product be re- leased to said claimant upon the payment of the costs of the proceedings and the execution of a bond in the sum o'f $750, in conformity with section 10 of the act, conditioned in part that the product should be sorted under the su- pervision of a representative of this department, and such portion as should be found fit for consumption should be released to said claimant, arid the unfit portion destroyed by the United States marshal. Upon report by the claimant that renovation of the product was impossible, on September 19, 1920, an order of the court was entered directing the United States marshal td destroy the product. E. D.
