On January 22, 1920, the United States attorney for the Eastern District of Pennsylvania, acting jipon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel for the seizure and condemnation of 10 bottles of Bonkocine, remaining unsold in the original unbroken packages at Philadelphia, .Pa., consigned by J. E. Gasson, Kentqn, Ohio, alleging that the article had been shipped on or about March 22, 1919,, and transported from the State of Ohio into the State of Pennsylvania, and cliarging misbranding in violation of the Food and Drugs Act, as Qmended. Analysis of a sample of the article by the Bureau of Chemistry of this depart- ment showed that it consisted essentially of an aqueous solution of magnesium sulphate ond berberine. A certain, most speedy, agree- able treatment for the above diseases and no others. * * ::' As a Preventa- tive Bonkocine used after an intercourse prevents the 'contracting of either Syphilis or Gonorrhea. It effectually eradicates both Syphilitic and Gonorrheal virus. * * * all complicated cases of Gonorrhea yield to treatment in from one to four days," were false and fraudulent in that the article would not produce the curative and therapeutic effects which purchasers were led to ex- pect by the above statements and which were applied tp the article with a knowledge of their falsity for the purpose of defrauding the purchasers thereof. On February 16, 1920, no claimant having appeared for the property, judg- ment of condemnation and forfeiture was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
