7941. Misbranding' ?? barley flonr. U. S. * * * v. Central Dakota Mill Co. Pica of grnilty. Fine, $50. (P. & D. No. 0800. I. S. No. 9G21~p.) On June 23, 1919, the United States attorney for the District of South Dakota, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district an information against the Central Dakota Mill Co., a corporation, Arlington, S. Dak., alleging shipment by said company, in violation of the Food and Drugs Act, as amended, on or about March 26, 3918, from the State of South Dakota into the State of Missouri, of a quantity of an article, labeled in part " Barley Flour," which was misbranded. The sacks bore no statement of weight, but were invoiced as 140 pounds net. Examination of 40 bags of the article by the Bureau of Chemistry of this department showed an average shortage per bag of 2.5 pounds, or 3.79 per cent. Misbranding of the article was alleged in the information for the reason that it was food in package form, and tlie quantity of the contents was not plainly and conspicuously marked on the outside of the package. On April 1, 1920, a plea of guilty to the information was entered on behalf of the defendant corporation, and the court imposed a fine of .$50. E, D. BALL, Acting Secretary of Agriculture.
