On July 21, 3920. the United States attorney for the Northern District of? Georgia, acting upon a report by iho Secretary of Agriculture, filed in the? District Court of the United States for'said district an information against? the Atlanta Cotton Oil Co., a corporation, Atlanta, (la., alleging shipment by? said company, in violation of the Food and Drugs Act, on or about November? 2,1, 1918, from the State of Georgia into the State of Kentucky, of a quantity? of cottonseed feed v, Inch was misbranded. Analysis of a sample of the article by the Bureau of Chemistry of (his de?? partment showed that it contained 32.8 per cent of proiein and 16.12 per cent? of crude fiber. Misbranding of the article was alleged in the information for the reason that? the statements, to wit, '' Guaranteed Analysis, Protein 36.00 Per Cent., Fiber? 14.00 Per Cent.." borne on the tags attached to the sacks containing the article,? regarding it and Hie ingredients and substances contained therein, were false? and misleading in that they represented to the purchasers thereof that the? article contained not less than 36 per cent of protein and not more than 14? per cent of fiber, and for the further reason that the article was labeled as? aforesaid so as to deceive and mislead the purchasers into tlie belief that it? contained not less than 36 per cent of protein and not more than 14 per cent? of fiber, whereas, in truth and in fact, it contained less protein and more fiber,? to wit, 32.8 per cent of protein and 16.12 per cent of fiber.
