On August 30, 1920, the United States attorney for the Eastern District of? Pennsylvania, acting upon a report by the Secretary of Agriculture, filed in the N. J. 8831-8900] SERVICE AND REGULATORY ANNOUNCEMENTS. 251 District Court of the United States for said district libels for the seizure? and condemnation of 2J dozen, 10 dozen, i dozen, and 20 dozen packages, more? or less, of Nerv-Mintz, consigned by the Earle Chemical Co., Wheeling, W. Va.,? remaining in the original unbroken packages at Philadelphia, Pa., alleging? that the article had been shipped on or about July 2, 1920, and transported? from the State of West Virginia into the State of Pennsylvania, and charging? misbranding in violation of the Food and Drugs Act, as amended. Analysis of a sample of the article by the Bureau of Chemistry of this de?? partment showed that the tablets consisted essentially of sabal, mix vomica,? zinc phosphid, aloin, and capsicum. It was alleged in substance in the libels that the article was misbranded in? that certain statements appearing on the label and in the circular were false? and fraudulent for the reason that the article would not produce the curative? or therapeutic effects which purchasers were led to expect by the said state?? ments, which were applied to said article with a knowledge of their falsity? for the purpose of defrauding purchasers thereof, as follows: (Box) "Nerv-?
