California, acting upon a report by the Secretary of Agriculture, filed in the? District Court of the United States for said district a libel for the seizure and? condemnation of 20 dozen boxes of Planten's C & C or Black Capsules, remain?? ing in the original unbroken packages, at San Francisco, Calif., alleging that? the article had been shipped by H. Planten & Son, Brooklyn, N. Y., on January? 20, 1919, and transported from the State of New York into the State of Califor?? nia, and charging misbranding in violation of the Food and Drugs Act, as? amended. Analysis of a sample cj. the article by the Bureau of Chemistry of this de?? partment showed that the contents of the capsules consisted essentially of? copaiba and volatile oils, including oil of cinnamon. Misbranding of the article was alleged in substance in the libel for the? reason that it was labeled in part, (carton) " Planten's C & C or Black Capsules? carefully prepared medicine of Compound Copaiba Balsam and Cubeb Oil, with? carminatives and disinfectants ??= * * from the laboratory of H. On October 11, 1919, H. Planten & Son, Brooklyn, N. Y., having entered an? appearance as claimant for the property, and the case having come on for final? disposition, decree by consent was entered adjudging the product to be mis-? branded, and it was ordered by the court that the product be released to said? claimant upon payment of the costs of the proceedings and the execution of a? bond in the sum of $100, in conformity with section 10 of the act.
