On July 28, 1920, the United States attorney for the District of Maine, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district libels praying the seizure and condemnation of 43 barrels, 6 barrels, and 80 barrels of a product labeled, respectively, in part, " Crescent Brand Pure Cider Vinegar," " Pure Cider Vinegar Imperial Brand," and " Pure 4C Cider Vinegar," consigned by F. E. Jewett & Co., Lowell, Mass., remaining unsold in the original unbroken packages at Portland and Bangor, Me., alleging that the article had been shipped on or about June 12 and May 7, 1920, and transported from the State of Massachusetts into the State of Maine, and charging adulteration and misbranding in violation of the Food and Drugs Act. Adulteration of the article was alleged in the libels for the reason that dis- tilled vinegar had been mixed and packed with, and substituted wholly or in part for, apple cider vinegar. Misbranding was alleged for the reason that thestatements appearing in the labeling of the article, respectively, to wit, " Crescent Brand Pure Cider Vin- egar," " Pure Cider Vinegar," and " Pure 4C Cider Vinegar made from' Apples," were false and misleading so as to deceive5 and mislead the purchaser, and for the further reason that said article was an imitation of, and offered for sale under the distinctive name of, another article. On August 30 and September 13, 1920, and February 10, 1921, no claimant having appeared for the property, judgments of condemnation and forfeiture were entered, and it was ordered by the court that the ^product be destroyed by the'United States marshal and that the barrels in which the same was contained be sold.
