9810. Misbranding of canned salmon. V. S- * * * v. Tallant-Grant Packing Co., a Corporation. Plea of guilty. Fine, $100. (F. & D. No. 11135. I. S. No. 14285-r.) On March 9, 1921, the United States attorney for the District of Oregon, act- ing upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district an information against the Tallant-Grant Packing Co., a corporation, Astoria, Oreg., alleging shipment by said company, In violation of the Food and Drugs Act, on or about November 4, 1918, from the State of Oregon into the State of New York, of a quantity of canned salmon which was misbranded. Examination of a sample of the article by the Bureau of Chemistry of this department showed that it consisted of chinook salmon. Misbranding of the article was alleged in the information for the reason that the label appearing on the cases containing the said article, to wit, " Columbia River Salmon," was false and misleading in that it represented to purchasers thereof that the said article was Columbia River salmon, whereas, in fact and in truth, it was California salmon; for the further reason that it was falsely branded as to the State wherein it was produced, as follows, " Packed at As- toria, Oregon," so as to represent to purchasers thereof that it was packed in Oregon, whereas, in fact and in truth, it was packed in California; and for the further reason that the said article was an imitation of, and was sold under the name of, another article, to wit, Columbia River salmon, whereas, in fact and in truth, it was California salmon. On August 8, 1921, a plea of guilty to count 2 of the information charging misbranding was entered on behalf of the defendant company, and the court imposed a fine of $100. C. W.
