Big    G.    Default    decree    of    condemnation,    forfeiture,    and    destruction.

On June 16, 1919, the United States attorney for the Southern District?
of Georgia, acting upon a report by the Secretary of Agriculture, filed in the?
District Court of the United States for said district a libel for the seizure?
and condemnation of 5 dozen bottles of Big G, remaining unsold in the?
original packages at Augusta, Ga., alleging that the article had been shipped?
by the Evans Chemical Co., Cincinnati, Ohio, on or about November 7, 1918,?
and transported from the State of Ohio into the State of Georgia, and charging?
adulteration and misbranding in violation of the Food and Drugs Act, as?
amended.
Analysis of a sample of the article by the Bureau of Chemistry of this?
department showed that it consisted essentially of an aqueous solution of?
borax and berberine.   Hydrastine was absent.
Adulteration of the article was alleged in substance in the libel for the?
reason that the carton containing the article bore the statement, " compound?
of Borated Goldenseal," whereas the said article contained no borated golden??
seal and its strength and purity fell below the professed standard and quality?
under which it was sold.
Misbranding was alleged for the reason that the statement on the said?
carton that the article was a compound of borated goldenseal was false and?
misleading for the reason that the said article contained no goldenseal.?
Misbranding was alleged in substance for the further reason that the following?
statements appearing on the labels of the carton and bottle containing the?
article and in the accompanying booklet, regarding the curative and thera??
peutic effects of the said article, to wit, (in English, with equivalent statements?

On October 11, 1921, no claimant having appeared for the property, judgment?
of condemnation and forfeiture was entered, and it was ordered by the court?
that the product be destroyed by the United States marshal.
