12302. Adulteration of prunes. U. S. v. 57 Sacks of Prunes. Default decree of condemnation, forfeiture, and destruction. (F. & D. No.- 18153. I. S. No. 15798-v. S. No. E-5628.) On December 11, 1923, the United States attorney for the Southern District of New York, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying the seizure and condemnation of 57 sacks of prunes remaining unsold in the original unbroken packages, at New York, N. Y., alleging that the article had been shipped from Constanza, Roumania, into the State of New York, and charging adulteration in violation of the food and drugs act. Aduleration of the article was alleged in the libel for the reason that the article consisted wholly or in part of a filthy, decomposed vegetable substance. On May 2, 1924, no claimant having appeared for the property, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
