12802. Adulteration of butter. U. S. v. 35 Boxes of Butter. Product re-

On or about July 30, 1924, the United States attorney for the Southern Dis- 
trict of California, acting upon a report by the Secretary of Agriculture, filed 
in the District Court of the United States for said district a libel praying the 
seizure and condemnation of 35 boxes of butter, remaining in the original 
unbroken packages at Los Angeles, Calif., consigned by the Northern Creamery 
Co., Great Falls, Mont., alleging that the article had been shipped from Great 
Falls, Mont., on or about July 8, 1924, and transported from the State of 
Montana into the State of California, and charging adulteration in violation 
of the food and drugs act.
Adulteration of the article was alleged in the libel for the reason that a 
product deficient in milk fat had been substituted wholly or in part for butter, 
and for the further reason that a valuable constituent, namely, milk fat, had 
be*en partially abstracted therefrom.
On September 4, 1924, the Stanley Brokerage Co., Los Angeles, Calif., having 
appeared as claimant for the property, and the product having theretofore been 
released under bond to the said claimant and reworked and rechurned so that 
it met the requirements of the act, a final decree was entered, dismissing the 
libel and ordering that the Government recover its costs.
