1.17G3. Adulteration and misbranding of prepared mustard. TJ. S. v. 65 Cartons of Prepared Mustard. Product relabeled and released under bond, (P. & D. No. 19419. I. S. No. 21008-v. S. No. W-931.) On December 27, 1924, the United States attorney for the Western District of Washington, acting upon a report by the Secretary of Agriculture",, filed in the District Court of the United States for said district a libel praying the seizure and condemnation of 65 cartons of prepared mustard, at Tacoma, Wash., alleging that the article had been shipped by A. Luedemann, Inc., from New York, N. Y., arriving at Tacoma, Wash., about December 15, 1924, and trans- ported from the State of New York into the State of Washington, and charg- ing adulteration and misbranding in violation of the food and drugs act. The article was labeled in part: " Dusseldorf Brand Prepared Mustard * * * A. Luedemann, Inc. New York." Adulteration of the article was alleged in the libel for the reason that a substance, an imitation mustard, had been mixed and packed therewith so as to reduce, lower, or injuriously affect its quality and strength and had been substituted wholly or in part for the said article. Adulteration was alleged for the further reason that the article had been colored in a manner whereby its inferiority was concealed. Misbranding was alleged for the reason that the statement " Prepared Mustard," borne on the label, was false and misleading and deceived and mis- led the purchaser, and for the further reason that the article was an imita- tion of and offered for sale under the distinctive name of another article. On August 1, 1925, the Tacoma Grocery Co., Tacoma, Wash., claimant, hav- ing paid the costs of the proceedings and having properly labeled the product and executed a good and sufficient bond, conditioned that the product not be sold or otherwise disposed of contrary to law, a decree of the court was entered, ordering that the product be delivered and released to the said claimant.
