On November 12, 1925, the United States attorney for the Eastern District of Illinois, acting upon a report by the Secretary of Agriculture, filed in the Dis- trict Court of the United States for said district a libel praying seizure and condemnation of 500 sacks of red dog, remaining in the original unbroken packages at East St. Louis, Ill., consigned by the I. S. Joseph Co., alleging that the article had been shipped from Minneapolis, Minn., on or about September 12, 1925, and transported from the State of Minnesota into the State of Illinois, and charging adulteration and misbranding in violation of the food and drugs act as amended. The article was unlabeled but was designated as " Red Dog." It was alleged in substance in the libel that the article was adulterated in violation of section 7, paragraph 2 under food, of the said act, in that it con- sisted wholly or in part of a mixture of ground bran and screenings and a low- grade flour. Misbranding was alleged for the reason that the article was an imitation of and offered for sale under the distinctive name of another article, and for the further reason that it was food in package form and the quantity of the con- tents was not plainly and conspicuously marked on the outside of the package. On April 19, 1926, the I. S. Joseph Co., Inc., Minneapolis, Minn., having appeared as claimant for the property and having admitted the allegations of the libel, judgment of condemnation and forfeiture was entered, and it was ?rdered by the court that the product be released to the said claimant upon payment of the costs of the proceedings and the execution of a bond in the sum of $2,000, in conformity with section 10 of the act.
