No. E-4817.) r On April 23, 1924, the United States attorney for the Middle District of Pennsylvania, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure and condemnation of 1xh gallons of chocolate concentrate, remaining in the original unbroken packages at Scranton, Pa., alleging that the article had been shipped by the Jack Beverages, Inc., from New York, N. Y., on or about April 5, 1924, and transported from the State of New York into the State of Penn- sylvania, and charging adulteration in violation of the food and drugs act. The article was labeled in part: "5 Gals. Real Chocolate Concentrate * * * Jack Beverages, Inc. *--*-"? * New York City." - Adulteration of the article was alleged in the libel for the reason that it contained an added poisonous or other added deleterious ingredient, salicylic acid, which might have rendered it injurious to health. On September 16, 1925, no claimant having appeared for the property, judg- ment of condemnation and forfeiture was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
