On January 14, 1927, the United States attorney for the District of Massa?? chusetts, acting upon a report by the Secretary of Agriculture, filed in the Dis?? trict Court of the United States for said district a libel praying seizure and? condemnation of 24 cases of canned cherries, remaining in the original unbroken? packages at Boston, Mass., alleging that the article had been shipped by the? Geneseo Jam Kitchen (Inc.), Geneseo, N. Y., and transported from the State of? New York into the State of Massachusetts, and charging adulteration in viola?? tion of the food and drugs act. It was alleged in the libel that the article was adulterated, in that it con?? sisted in whole or in part of a filthy, decomposed, or putrid vegetable substance. On February 10, 1927, no claimant having appeared for the property, judg?? ment of condemnation and forfeiture was entered, and it was ordered by the? court that the product be destroyed by the United States marshal.
