No. E-3588.) )n September 2S, 1921, the United States attorney for the Western District of rth Carolina, acting upon a report by the Secretary of Agriculture, filed in ^District Court of the United States for said district a libel praying seizure Id condemnation of 10 barrels of vinegar, at Asheville, N. C, alleging that the fticle had been shipped by the Douglas Packing Co., from Canastota, N. Y., Iigust 5, 1921, and transported from the State of New York into the State of |prth Carolina, and charging adulteration- and misbranding in violation of the )d and drugs act. The article was labeled in part: "Douglas Packing Co. 2elsior Brand Apple Cider Vinegar Made From Selected Apples * * * achester." I^t was alleged in substance in the libel that the article was adulterated, in it vinegar made from dried apple products had been mixed and packed there- ith so as to reduce, lower, or injuriously affect its quality, and had been sub- patuted wholly or in part for apple cider vinegar, ^Misbranding was, alleged for the reason that the statement "Apple Cider hiegar Made from Selected Apples " was false and misleading when applied tf'k product made from dried apple products. Misbranding was alleged for the further reason that the article was an imitation of and was offered for sale ider the distinctive name of another article. ' ipn February 13, 1925, the Douglas Packing Co., Rochester, N. Y., having jjpeared as claimant for the property, judgment was entered, finding the prod- let misbranded and ordering its condemnation and forfeiture, and it was tur- ner ordered by the court that the said product be released to the claimant upon j|yment of the costs of the proceedings and the execution of a bond in the sum H?$200, conditioned that it not be sold or otherwise disposed of contrary to m.
