15180. Adulteration and Misbranding of butter. TJ. S. v. 150 Pounds of Butter. Consent decree of destruction entered. (F. & D. No. 21288?: I. S. No. 3348-x. S. No. C-5233.) : On August 24, 1926, the United States attorney for the Western District of Wisconsin, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure andH condemnation of 150 pounds of butter, remaining in the original unbroken pack- ages at Superior, Wis., alleging that the article had been shipped by Wilson &^ Co., from Duluth, Minn., on or about August 13, 1926.' and transported from the'' State of Minnesota into the State of Wisconsin, and charging adulteration anisU misbranding in violation of the food and drugs act. The article was labeled icr part: (carton) "Lake View Creamery Butter * * * Lake View Butter- Sweet-Pure-Delicious W Wilson & Co." Adulteration of the article was alleged in the libel for the reason that a sub stance deficient in butterfat had been mixed and packed therewith so as td'" reduce and lower and injuriously affect its quality and strength, and had been substituted wholly or in part for the said article. Misbranding was alleged for the reason that the statements " Creameryt Butter " and " Lake View Butter, Sweet-Pure," borne on the label, were false* and misleading and deceived and misled purchasers, and that the article wa^ offered for sale under the distinctive name of butter. On November 15, 1926, by consent of the parties in interest, a decree wa$ entered, adjudging the product adulterated and misbranded, and ordering that it be destroyed by the United States marshal. W.
