On .December 17, 1921, the United States attorney for the Western District Wisconsin, acting upon a report by the Secretary of Agriculture, filed in District Court of the United States for said district a libel praying seizure arS condemnation of 25 barrels of vinegar, remaining in the original unbroken pac ages at Superior, Wis., alleging that the article had been shipped by the Douglij Packing Co., from Canastota, N. Y., on or about November 9, 1921, and trari| ported from the State of New York into the State of Wisconsin, and chargi;' adulteration and misbranding in violation of the food and drugs act. TB article was labeled in part: "Apple Cider Vinegar Made from Selected Applel * * * Rochester, N. Y." It was alleged in substance in the libel that the article had been adulterate in violation of said act, in that an evaporated and dried apple product had bee: mixed and packed with and substituted wholly or in part for the said article. Misbranding was alleged for the reason that the statement, to wit, " Appi Cider Vinegar Made from Selected Apples," was false and misleading ai* calculated to deceive and mislead purchasers thereof, in that the said statemenj represented that the article was made from selected apples and was apple ci&4 vinegar, whereas it was not. Misbranding was alleged for the further reasof that the article was offered for sale and sold under the name of another article On December 15, 1924, the Douglas Packing Co., Rochester, N. Y., havi: appeared as claimant for the property, judgment of the court was entered, fim ing the product misbranded and ordering its condemnation and forfeiture, anl it was further ordered by the court that the said product be released to th< claimant upon payment of the costs of the proceedings and the execution of bond in the sum of $500, conditioned in part that it not be sold or otherwisi disposed of contrary to law. ; W.
