No. 108 ) On September 20, 1927, the United States attorney for the District Massachusetts, acting upon a report by the Secretary of Agriculture, filed the District Court of the United States for said district a libel praying seizi; and condemnation of 19 cases of canned cherries, remaining in the origir unbroken packages at Boston, Mass., consigned about August 30, 1927, allegi that the article had been shipped by the Geneseo Jam Kitchen, Inc., of Genes N Y., and transported from the State of New York into the State of Mas chusetts, and charging adulteration in violation of the food and drugs act. It was alleged in the libel that the article was adulterated, in that it a m< sisted in part of a filthy, decomposed, and putrid vegetable substance. V On October 13, 1927, no claimant having appeared for the property, judgmi !*>' of condemnation and forfeiture was entered, and it was ordered by the co &' t that the product be destroyed by the United States marshal. re R.
