No. 63 ) ' On August 9, 1927, the United States attorney for the Western District of ' Kentucky, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure 2 and condemnation of 121 cases of shell eggs, remaining in the original un- 8 broken packages at Louisville, Ky., consigned by Marshall Bros., New Albany, I' Ind., in part July 16, 1927, and in part July 27, 1927, alleging that the article | had been transported in interstate commerce from New Albany, Ind., into the \, State of Kentucky, and charging adulteration in violation of the food and 5j drugs act A portion of the article was labeled, " Dirties," or " Dirties and | Seconds." | ? It was alleged in the libel that the article was adulterated, in that it con- | sisted in part of a filthy, decomposed, and putrid animal substance. \i On August 10, 1927, Marshall Brothers, New Albany, Ind., having appeared |j as claimant for the property, judgment of condemnation was entered and it | was ordered by the court that the product be released to the said claimant 1> upon the execution of a bond in the sum of $1,000, conditioned in part that h the eggs be sorted under the supervision of this department and the decomposed ft. portion destroyed. s. u$ W.
