I On January 3, 1928, the United States attorney for the District of Maryland,
I acting upon a report by the Secretary of Agriculture, filed in the District Court
| of the United States for said district libels praying seizure and condemnation
of liy^ dozen bottles of Lifo herb medicine, remaining in the original unbroken 
packages at Baltimore, Md., alleging that the article had been shipped by the 
Lifo Medicine Co., from Philadelphia, Pa., in various consignments on or about 
June 23, October 17, and November 22, 1927, respectively, and had been trans- 
i. ported from the State of Pennsylvania into the State of Maryland and charging
I misbranding in violation of the food and drugs act as amended.

Analysis of a sample of the article by this department showed that it con-
I sisted essentially of bitter and  laxative plant drug extracts,  salicylic  acid,
| alcohol, and water.
E It was alleged in the libels that the article was misbranded, in that the
I packages failed' to bear a statement on the label of the quantity of alcohol
I contained therein.

Misbranding was alleged for the further reason that the following state-
| ments, regarding the curative and therapeutic effects of the said article, were
r false and fraudulent, since it contained no ingredient or combination of ingredi-
| ents capable of producing the effects claimed:   (Bottle label)   "Lifo    *    *    *

neys and Bowels. A Grand System Cleanser and Nerve Tonic * * * Aid 
Nature in Rebuilding Weak, Overworked and Run Down Systems; " (circular)

On February 23, 1928, no claimant having appeared for the property, judg- 
ments of condemnation and forfeiture were entered, and it was ordered by the 
court that the product be destroyed by the United States marshal.
