15949. Adulteration of dressed poultry. U. S. v. 9 Barrels of Dressed Poultry. Consent decree of condemnation and forfeiture. Product released under bond. (F. & D. No. 23059. I. S. No. 03023. S. On September 7, 1928, the United States attorney for the Southern District of New York, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure and condemnation of 9 barrels of dressed poultry', remaining in the original un- broken packages at New York, N. Y., consigned by the Seymour Packing Co., Topeka, Kans., alleging that the article had been shipped from Topeka, Kans., on or about August 25, 1928, and transported from the State of Kansas into the State of New York, and charging adulteration in violation of the food and drugs act. It was alleged In the libel that the article was adulterated in that it con- sisted in part of a portion of an animal unfit for food, and in that it was a product of a diseased animal. On September 17, 1928, the Seymour Packing Co., Topeka, Kans., claimant, having admitted the allegations of the libel and having consented to the entry of a decree, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product be released to the said claimant upon pay- ment of the costs of the proceedings and the execution of a bond in the sum of $350, conditioned in part that the bad portion be separated from the good por- tion and the former destroyed or denatured under the supervision of this department.
